1. Who we are
Publitik is an editorial intelligence platform operated by BMS Consultoria, Serviços e Comércio Ltda., registered under Brazilian CNPJ 46.370.980/0001-15, based at Av. das Américas, 3,500 — Block 5, Suite 615, Barra da Tijuca, Rio de Janeiro/RJ, ZIP 22.640-102, Brazil (referred to as "Publitik", "we" or "operator"). This document governs the relationship between the operator and the individual or legal entity that contracts the service (referred to as "you", "user" or "subscriber").
By creating an account, starting the trial or subscribing to a plan, you declare that you have read, understood and fully accepted these Terms. Acceptance is a condition for using the service.
2. What we offer
Publitik aggregates, classifies via artificial intelligence and surfaces in a single dashboard public content from the Brazilian and international publishing market — including press, bestseller charts and social media content where applicable. The service is delivered as SaaS (software as a service), via web browser, under recurring subscription.
The coverage of sources may change over time. We do not guarantee the inclusion or continued availability of any specific source. The current list is displayed in the dashboard.
3. Sign-up and account
To use Publitik you must create an account with a valid email address. You are responsible for keeping your credentials confidential and for all activity carried out under your account. Notify us immediately in case of unauthorized use.
You declare that you are at least 18 years old or have adequate legal representation, and that the information provided at sign-up is true and up to date.
4. Free trial
Every new account starts with 7 days of access to the Pro plan unlocked, with no credit card required. No amount is charged during the trial and no charge is automatically scheduled.
Once the 7-day period ends, access is automatically reduced. To continue with full access, the user must subscribe to a plan by entering payment details. Billing only occurs after explicit subscription.
5. Subscription and billing
After the trial ends without cancellation, the subscription is automatically activated on the chosen plan, with recurring monthly or annual billing depending on your option, via credit card processed by Stripe Brasil Instituição de Pagamento Ltda. (payment partner).
- The applicable prices are the ones displayed on the Pricing page at the time of subscription.
- Annual price adjustments are communicated at least 30 days in advance.
- The service invoice is issued and made available in the dashboard after each charge.
- If a charge fails, we will retry for up to 7 days. After that period, access is suspended until payment is settled.
6. Cancellation and refund
You can cancel your subscription at any time, in one click, directly from the dashboard or by emailing help@publitik.com. We detail the timelines and refund rules in the Refund Policy, which is an integral part of these Terms.
7. Permitted and prohibited use
You agree to:
- Use Publitik only for lawful purposes and in accordance with these Terms.
- Not share access credentials beyond the user limits set by your plan.
- Not resell, redistribute or publicly make available the content aggregated by Publitik without prior written authorization.
- Not attempt to access restricted areas, circumvent technical limits, reverse engineer or scrape content automatically beyond what your plan allows.
- Respect the copyright of original sources. Publitik provides the headline, summary and a link to the original publication — full consumption must be done at the source.
Non-compliance may result in immediate account suspension without refund, without prejudice to any applicable legal liability.
8. Intellectual property
The Publitik brand, software, dashboard, classification algorithms, layouts, proprietary copy and all other elements of the service are the exclusive property of the operator. The user is granted a personal, non-transferable and non-exclusive license to use the service during the subscription term.
The content of aggregated sources belongs to the respective publishers of origin. Publitik is a discovery and curation platform with AI classification. AI-generated summaries are for the subscriber's internal use only; republication is not authorized.
9. Availability and support
We strive to keep the service available 24/7. We do not guarantee continuous, uninterrupted availability — planned maintenance is announced in advance. Failures in external sources (unavailable RSS, layout changes on scraped sites) may temporarily affect coverage.
Support is provided via email at help@publitik.com on business days, Monday to Friday, 9am to 6pm (BRT), with response time within 1 business day.
10. Limitation of liability
Publitik provides information to support decision-making. We are not responsible for commercial decisions made based on dashboard content, nor for inaccuracies from source publishers or from AI classification.
In any event, the operator's liability for direct damages, to the maximum extent permitted by law, is limited to the amount paid by the user in the 12 months preceding the event giving rise to the claim.
11. Privacy and data protection
Personal data processing follows the Privacy Policy, an integral part of these Terms, in compliance with the Brazilian General Data Protection Law (LGPD — Law 13,709/2018).
12. Changes to these Terms
We may update these Terms at any time. Material changes will be communicated by email at least 15 days in advance. Continued use of the service after the effective date constitutes acceptance. If you disagree, you may cancel the subscription.
13. Jurisdiction and applicable law
These Terms are governed by Brazilian law. The courts of the District of Rio de Janeiro/RJ, Brazil are elected to settle any matters arising from this contract, with waiver of any other, however privileged, except as provided in the Brazilian Consumer Protection Code for individual users.
